Port Orange, FL Fence Regulations: Fence Permit Requirements (2026)

Chapter 3, Section 2 of the Land Development Code, 'Development order and development permit required,' opens with a blanket rule: no development activity may be undertaken unless it is authorized by a development permit, and a development permit generally cannot be issued unless it is backed by a development order showing the work conforms to the code. Subsection (b) then lists nine categories of activity excused from needing the development order, meaning the city can issue the permit directly without the full development plan review, and 'erection of signs or fences on a previously developed site and when independent of other development activity on the site' is item (5) on that list.

The exemption is narrow: it only waives the development-order step, not the permit itself, and only applies when the fence is built on a lot that has already been developed and the fence work is not tied to some other construction project happening on the same site at the same time. A fence erected as part of a larger new-construction or major-remodel project on that same site does not qualify for the streamlined path and instead follows the standard development order and plan review process described in Chapter 3, Section 3.

The administrative official, appointed by the city manager, administers and enforces both tracks, and every application, including a stand-alone fence permit, is subject to whatever fee the city council sets by resolution to cover the average cost of review under Section 1(b) of the same chapter.
