A. Between the hours of ten o'clock (10:00) P.M. one day and seven o'clock (7:00) A.M. the next day, it shall be unlawful for any person or business to make, cause, or allow loud or unusual noise by means of voice, musical instrument, horn, radio, loudspeaker, automobile, machinery, other sound amplifying equipment, domesticated animals, or any other means which disturbs the peace, quiet, and comfort of any reasonable person of normal sensitiveness residing in the area. Loud or unusual noise is that which is plainly audible within any residence or business, other than the source of the sound, or upon a public right-of-way or street at a distance of one hundred feet (100') or more from the source of said sound.

Adopted in 1997 and amended most recently in 2021, the Ada County Noise Ordinance in Chapter 13 of Title 5 targets amplified sound and other loud activity during the county's overnight hours. Section 5-13-2 grounds the rule in Idaho Constitution article 12, section 2 and Idaho Code sections 31-714 and 31-801, and states its purpose as abating loud or offensive noises between 10:00 p.m. and 7:00 a.m. Section 5-13-3(A) then lists the sources it reaches: voice, musical instrument, horn, radio, loudspeaker, automobile, machinery, other sound amplifying equipment, domesticated animals, or any other means that disturbs the peace, quiet, and comfort of any reasonable person of normal sensitiveness residing in the area, which sweeps in backyard speakers, PA systems, live bands, and car stereos alike.

Two narrow seasonal carve-outs apply: construction noise and landscape maintenance noise may both start at 6:00 a.m. instead of 7:00 a.m. during June, July and August, due to extreme heat. Section 5-13-4 exempts emergency vehicles responding to a call, trains, FAA-regulated aircraft, and permitted public fireworks displays under Idaho Code title 39, chapter 26, and lets the Board grant other exemptions by resolution after weighing factors like how long the activity has run, how many people it serves, and whether a quieter alternative location exists. Anyone planning a louder event, an amplified outdoor concert or a late DJ set, can apply to the Board for a temporary waiver at least 30 days ahead and must notify every property owner within 300 feet of the event site as part of that application.

Violations & Fines

A violation of any part of the Ada County Noise Ordinance, including running amplified sound past 10:00 p.m. without a waiver, is a misdemeanor under Ada County Code 5-13-5, punishable as provided in Idaho Code section 18-113. That standard applies uniformly to a single loud radio, a full sound system at a private party, or a commercial event that skipped the Board's temporary-waiver process.
