Sec. 34-35(1) makes it a noise violation to operate a radio, television, exterior loudspeaker, musical instrument, phonograph, or similar sound-producing machine between 9:00 p.m. and 7:00 a.m. in a way that is plainly audible 50 feet or more from the source, meaning an officer using ordinary hearing, unaided by any microphone or hearing aid, can hear it from that distance under Sec. 34-34's detection standard.

For use on a public right-of-way, Sec. 34-35(16) goes further: any exterior loudspeaker, amplifier, or similar amplification device audible 50 feet away on a sidewalk or other right-of-way requires a permit from the city manager or designee before it can be used at all. The application must list the device owner and user, the exact location and time period of use, the maximum volume to be employed, and the expected number of attendees.

The city manager cannot issue a permit for more than five consecutive calendar days, cannot let permits overlap at the same location, and must deny any application for a spot within 500 feet of a school, courthouse, or church during its hours of operation, or within 500 feet of a hospital. A permit is also barred between 9:00 p.m. and 7:00 a.m., and the amplification device must stay stationary at the permitted location. Separately, Sec. 34-35(15) requires a special event permit before running an exterior loudspeaker for entertainment inside any city park, with volume capped at the same 50-foot audibility line.
