Full Breakdown
Section 160-6 of the Town of Irondequoit Code forbids using any radio, television, phonograph, musical instrument or other sound-producing machine with louder volume than is necessary for convenient hearing by voluntary listeners. Sound is prima facie evidence of a violation if it is audible beyond the property line of the premises between 10:00 p.m. and 8:00 a.m., or audible at a distance of 50 feet beyond the property line between 8:00 a.m. and 10:00 p.m. The same 50 foot test applies to a device operated from within a motor vehicle on a public street and to a device operated in a public park or other public place.
Exemptions in § 160-6B cover funeral processions and church use, music for an authorized parade, any musical performance in a public place where the Town Clerk issued a permit, and amplifiers used for religious or political activity or a permitted athletic competition or recreational event on athletic fields, stadiums or public places. A motor vehicle used in a violation is subject to towing and its associated fines.
Loudspeakers and sound trucks used in or upon streets, sidewalks, parks and public property fall under § 160-18. The user files a registration statement with the Town Clerk at least five days before use, listing the wattage, the volume in decibels and the approximate audible distance. Only music or human speech is allowed, and operation is limited to 8:00 a.m. to 10:00 p.m. each day, with commercial use barred on Sundays and legal holidays and noncommercial use on those days limited to 10:00 a.m. to 10:00 p.m. No sound can exceed 15 dB(A) above the ambient as measured at any property line, and operation within 200 feet of churches, schools or hospitals is unlawful unless the institution itself operates the equipment. Commercial users pay a fee set under § 1-18 for each day or portion of a day, and noncommercial use carries no fee.
Violations & Fines
Section 160-19 makes a violation of Chapter 160 a Class B violation, punishable under § 1-16 by a fine of not less than $100 nor more than $250, or not more than 15 days' imprisonment, or both, plus costs of restoration, and each day is a separate offense. Under § 160-6C a vehicle used in the violation is subject to towing and its associated fines. The Chief of Police enforces the chapter under § 160-20.
