Summary

In unincorporated Porter County, a dog or other animal that causes serious annoyance or disturbance to a neighborhood through loud, frequent, habitual or continual barking, howling or yelping is declared a nuisance under County Code Sec. 12-130, and it is unlawful to keep such an animal. The Porter County Sheriff's Department enforces the rule, and violators face a $50.00 fine for each violation.

These county ordinances apply to unincorporated areas of Porter County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)Any animal which shall cause serious annoyance or disturbance to a neighborhood or the residents therein by its loud, frequent, habitual or continual barking, howling, yelping or any other noise is declared to be a nuisance. It is unlawful for any person or persons to keep any such animal within the unincorporated areas of the county.(b)Enforcement. This section shall be enforced by the county sheriff's department.(c)Violations and penalties.(1)Any person violating the provisions of this section shall be fined $50.00 for each violation. Each day such violation is committed or permitted to continue shall constitute a separate cause of action and shall be punishable as set forth herein.(2)Pursuant to this section, the county animal shelter is authorized to seize and detain any animal which is the subject of this section if so requested by the county sheriff's department subsequent to the issuance of a citation for a violation of this section.

Full Breakdown

Porter County Code of Ordinances Sec. 12-130, adopted by Ord. No. 010, sits in Article VI, Noise Control, of Chapter 12, Health and Safety. It declares that any animal causing serious annoyance or disturbance to a neighborhood or its residents through loud, frequent, habitual or continual barking, howling, yelping or other noise is a nuisance, and it is unlawful for any person to keep such an animal within the unincorporated areas of the county; incorporated towns and cities such as Valparaiso, Portage and Chesterton write their own noise codes.

The Porter County Sheriff's Department is the enforcing agency named in subsection (b). 00 fine, and each day the barking nuisance continues or is permitted to continue counts as a separate cause of action, so repeated failures to correct the problem multiply the fine quickly. The ordinance also gives the sheriff's department a seizure remedy: once a citation has been issued, the county animal shelter may seize and detain the offending animal at the sheriff's department's request. If an animal is seized, the owner must reimburse the animal shelter for the costs of seizing and detaining it before the animal can be reclaimed, on top of the underlying fine.

Because the section only reaches unincorporated Porter County, residents inside an incorporated town or city must check that municipality's own animal-noise chapter rather than this county code section.

Violations & Fines

A citation under Sec. 12-130 is a $50.00 fine, and the fine applies again for each additional day the nuisance barking continues or recurs, so an uncorrected complaint can produce a new $50.00 charge daily. Beyond the fine, the county animal shelter can seize and hold the animal at the sheriff's department's request once a citation has issued, and the owner must pay the shelter's seizure and boarding costs before reclaiming the animal.

Frequently Asked Questions

Does Porter County's barking dog law apply inside Valparaiso or Portage?
No. Sec. 12-130 only reaches the unincorporated areas of Porter County. Residents of incorporated towns and cities within the county, including Valparaiso, Portage and Chesterton, fall under that municipality's own noise ordinance rather than this county code section.
How much is the fine for a barking dog complaint in Porter County?
The Porter County Sheriff's Department can issue a $50.00 fine for each violation of Sec. 12-130, and every day the nuisance barking continues after a citation counts as a new, separate violation, so the fine accumulates for an uncorrected problem.
Can Porter County seize a dog for excessive barking?
Yes. Once the sheriff's department has issued a citation under Sec. 12-130, the county animal shelter is authorized to seize and detain the animal at the department's request. The owner must reimburse the shelter's seizure and detention costs before reclaiming the animal.
