Summary

Weld County's unincorporated-area noise code sets no construction hours. Section 14-9-60(N) exempts any noise produced at a construction site from all of Article IX, so its decibel caps and citations do not reach ordinary building work. Oil and gas construction phases are the exception, held to separate limits in § 21-5-416.

City-specific rules exist: Greeley has its own construction hours rules that differ from Weld County's county-level regulations. If you live in Greeley, check the city-specific page instead.

Full Breakdown

Weld County's noise rules sit in Chapter 14, Article IX, and Section 14-9-10(B) confines them to the unincorporated territory of the County. Section 14-9-60 then lists what the Article "shall not apply to," and subsection N reads: "Any noise produced at a construction site." The exemption carries no hour limit, no decibel ceiling and no permit condition. Article IX prints no earliest start time and no latest quitting time for building work, so the county noise code does not set a construction curfew.

The definitions show how wide the exemption reaches. Section 14-9-20 defines Construction Activities as any and all activity incidental to the erection, demolition, assembling, alteration, installation or equipping of buildings, structures, roads and appurtenances thereof, including land clearing, grading, excavating and filling. That term also labels a row in the maximum-noise table of § 14-9-40, which lists Industrial Area or Construction Activities at 80 dB(A) from 7:00 a.m. to 9:00 p.m. and 75 dB(A) from 9:00 p.m. to 7:00 a.m. Read that row alongside subsection N with care: the exemption sentence is unconditional, and it is the text that speaks directly to noise at a construction site.

Neighboring exemptions in the same section cover related work. Subsection D exempts noise from agricultural equipment used on a farm or ranch, subsection J exempts the sound of a lawnmower, snow blower or other power or hand tool, and subsection L exempts noise produced in the course of normal mining operations or oil and gas exploration, drilling and production.

Oil and gas is where Weld County does set construction-phase limits, in Chapter 21, Article V, § 21-5-416. During the Construction Phase, Operators in the Ag-Rural Planning Area must meet the NL-4 standard: 70 db(A) from 7:00 a.m. to 7:00 p.m. and 65 db(A) from 7:00 p.m. to 7:00 a.m. Operators in the Near-Urban Planning Area must meet NL-3: 65 db(A) by day and 60 db(A) by night. Readings are taken twenty-five (25) feet from the exterior wall of the impacted building unit, and the OGED Director can require a lower level. Impulsive or shrill noise gets an extra five (5) db(A) for no more than 15 minutes in any 1-hour period.

Violations & Fines

Section 14-9-70 authorizes law enforcement officers, Department of Planning Services officers and the Health Official to cite violations of Sections 14-9-40 and 14-9-50, and § 14-9-60 says the Article does not apply to construction-site noise. For the noise Article IX does cover, a violation is a Class II petty offense: $30 for the first, $60 for a second within 12 months, and $300 for each successive violation within 12 months, plus a $10 surcharge. An oil and gas operator over the § 21-5-416 levels must obtain a noise impact analysis from a qualified sound expert, ordered by the OGED Director.

Frequently Asked Questions

Can a contractor start work in unincorporated Weld County at dawn?
Article IX of Chapter 14 prints no earliest start time for construction, and § 14-9-60(N) says the Article does not apply to any noise produced at a construction site. The county noise code therefore gives a neighbor no curfew to enforce against ordinary building work. Oil and gas construction is different and follows § 21-5-416 day and night limits.
Does the 80 dB(A) construction row in the noise table apply?
Section 14-9-40 lists Industrial Area or Construction Activities at 80 dB(A) from 7:00 a.m. to 9:00 p.m. and 75 dB(A) from 9:00 p.m. to 7:00 a.m. Section 14-9-60(N), however, states that the Article's provisions shall not apply to any noise produced at a construction site, and it attaches no condition to that exemption.
Are power tools and equipment on a job site covered?
Subsection J of § 14-9-60 exempts the sound made by a lawnmower, snow blower or other power or hand tool. Subsection D exempts agricultural equipment used on a farm or ranch. Between those and subsection N, the common sources of job-site noise fall outside the Article IX decibel limits and its citation schedule.
What limits apply to oil and gas construction near homes?
Section 21-5-416 governs. In the Ag-Rural Planning Area the Construction Phase must meet NL-4, which is 70 db(A) from 7:00 a.m. to 7:00 p.m. and 65 db(A) from 7:00 p.m. to 7:00 a.m. In the Near-Urban Planning Area it must meet NL-3, 65 db(A) by day and 60 db(A) by night, measured 25 feet from the building wall.
Can an operator exceed the oil and gas noise levels?
Yes, with a written waiver. Section 21-5-416.A.3 lets an Operator exceed the Table 416 A.1 levels at the nearest noise compliance point if all reasonably affected Surface Owners and tenants within the 1041 WOGLA Zone provide a written waiver to the higher limit the Operator requests.
