The section defines "construction equipment" broadly to include pile drivers, bulldozers, pneumatic hammers, derricks, dump trucks, cement trucks, cement mixers, and steam or electric hoists, so the restriction covers essentially every piece of heavy gear used on a job site, not just jackhammers or bulldozers narrowly defined. The Common Council carved out public construction performed by or under contract with the City, Dane County, the State of Wisconsin or a federal agency, but that exception does not extend to private construction, and it specifically does not extend to public improvements built solely because a developer's agreement required them, unless that agreement itself authorizes different hours.

Contractors who face a genuine scheduling emergency can ask the Building Inspector for a variance permit, but the Inspector may grant one only where unique circumstances create significant hardship extraordinary enough to warrant special consideration, and only for the time actually needed to relieve that hardship. Before issuing a variance the Inspector must weigh the cause, nature and degree of the hardship against neighboring property owners' reasonable expectation of peaceful enjoyment, and the ordinance requires written consent from at least one adult resident of every household within 150 feet of the work before any variance can be granted.
