Provo has no chapter setting fixed start and stop times for construction. Construction noise is governed by the general Chapter 9.06 dBA limits, and special construction projects may obtain a written noise-exemption permit from the Mayor.
Provo City Code Chapter 9.06 does not impose a dedicated construction curfew with fixed hours. Instead, construction noise that crosses a property line is subject to the general dBA limits in Section 9.06.040 (for residential receiving property, 55 dBA between 10:00 p.m. and 7:00 a.m. and 65 dBA between 7:00 a.m. and 10:00 p.m.; 75 dBA for industrial; 65/70 dBA for all other areas). Section 9.06.050(1) allows noise generated by special construction projects (along with parades, carnivals, and public social events) to be granted an exemption from some or all of the chapter's noise restrictions by means of a written permit issued by the Mayor or the Mayor's designee, which must specify the nature of the activity, the maximum allowable noise level in dBA, and the duration of the exemption. By contrast, Provo expressly exempts only landscaping equipment operating between 8:00 a.m. and 8:00 p.m. (Sec. 9.06.050(2)(h)); construction itself has no such blanket time-of-day exemption and must either meet the dBA limits or hold a permit.
Construction noise that exceeds the Section 9.06.040 limits without a permit is a class B misdemeanor (Sec. 9.06.070(1)), with each occurrence a separate offense, and is a nuisance subject to summary abatement by restraining order or injunction (Sec. 9.06.070(2)). Violating the conditions of an exemption permit may cause the exemption to be revoked (Sec. 9.06.050(1)).
