Construction hours in Sioux City, IA β sometimes called construction noise rules or contractor work-hour ordinances β set when contractors can run power tools, hammers, and heavy equipment.
Sioux City limits permitted construction to roughly 7:00 a.m. to 9:00 p.m. Section 8.68.030(8) makes the sound of construction equipment audible at the property line between 9:00 p.m. and 7:00 a.m. a per se 'noise disturbance,' and Β§8.68.040(12) expressly excludes construction noise from the disturbance rule only when it is performed between 7:00 a.m. and 9:00 p.m. under a current building permit.
Sioux City uses a two-part structure for construction hours. Section 8.68.030(8) of the Sioux City Municipal Code (Ord. 2007-0524) defines 'Construction Noise' as: 'The sound made by tools or equipment in erection, demolition, excavation, drilling or other such construction work which is received between the hours of 9:00 p.m. and 7:00 a.m. audible at the real property boundary where the source is located,' and includes it on the list of 'noise disturbances' prohibited by Β§8.68.020. Section 8.68.040(12) carves out an exemption from the disturbance rule for: 'The sound emitted by construction work (erection, demolition, excavation, drilling, etc.) between the hours of 7:00 a.m. and 9:00 p.m., which is being performed pursuant to a proper and current building permit.' Together, those two sections mean permitted construction is legal 7:00 a.m. to 9:00 p.m. daily. Bridge, street, or highway work performed by or on behalf of the City, State, or federal government may run between 7:00 p.m. and 7:00 a.m. when work cannot practically be done in the day window (Β§8.68.040(18)). The Sioux City Police Department enforces; chronic violators can also face stop-work orders from Inspection Services.
Off-hours construction noise is a noise disturbance under Β§8.68.030(8) and Β§8.68.020, punishable as a municipal infraction or simple misdemeanor per Β§8.68.080 and Β§1.04.100. Contractors operating without a current building permit lose the Β§8.68.040(12) exemption entirely and remain liable for daytime noise.
