A related exemption in SVMC 7.05.040(K)(3) covers sounds from residential property relating to temporary projects for the repair or maintenance of homes, grounds and appurtenances, again only between 7:00 a.m. and 10:00 p.m. In practice this means contractors and homeowners may generate construction noise during the day, but the same noise before 7:00 a.m. or after 10:00 p.m. within 1,000 feet of a residence loses its protection and may be enforced as a nuisance under Chapter 17.100 SVMC. Work performed at the cost of the federal, state or municipal government for public works projects is separately exempt.
Construction or related noise outside 7:00 a.m. to 10:00 p.m. (within 1,000 feet of a residence) is not exempt and may be cited as a public nuisance under Chapter 17.100 SVMC, with warnings, notices and order, and civil penalties.
