Section 6.70.030(5) of Marin County Code restricts loud noise-generating construction-related equipment — including backhoes, generators, and jackhammers — to operate, be maintained, or be serviced from 8 AM to 5 PM Monday through Friday only at sites with permits administered by the Community Development Agency. General construction activity is allowed 7 AM to 6 PM weekdays and 9 AM to 5 PM on Saturdays. All construction is prohibited on Sundays and on these holidays: New Year's Day, President's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, and Christmas Day.
Construction outside permitted hours is an infraction under §6.70.040, enforceable by fines or administrative action. Continuing after a directive to cease is a misdemeanor. CDA may also condition or revoke building permits for repeated noise violations on the site.
