Tustin City Code Section 4616(2) prohibits construction, demolition, alteration, repair, excavation, grading and paving between 6 p.m. and 7 a.m. Monday-Friday, between 5 p.m. and 9 a.m. on Saturdays, and during all hours on Sundays and city-observed federal holidays. The Building Official or Public Works Director may grant a written temporary exception for urgent necessity.
Construction noise is regulated by the City of Tustin's own code, not Orange County's. Section 4616(2) makes it unlawful to perform erection, demolition, alteration, repair, excavation, grading, paving or construction of any building or site between 6:00 p.m. and 7:00 a.m. Monday through Friday, between 5:00 p.m. and 9:00 a.m. on Saturdays, and during all hours on Sundays and city-observed federal holidays. Material deliveries, loading, equipment service and maintenance vehicles tied to a project are likewise barred outside approved construction hours. Section 4616(3) separately restricts pile drivers, power shovels, pneumatic hammers, grading/excavating machinery and paving equipment to the same windows. Section 4617(e) confirms that construction noise occurring 7 a.m.-6 p.m. weekdays and 9 a.m.-5 p.m. Saturdays (excluding holidays) is exempt from the chapter's decibel standards. For urgent necessity, the Building Official (private property) or Director of Public Works (public property) may grant a written temporary exception that will not adversely affect adjacent properties; the request must state specific times, dates and locations, and any approval may be summarily revoked.
A violation of Chapter 6 construction-hour limits is a misdemeanor under Section 4625, with each day treated as a separate offense. Code Enforcement and the Police Department respond to off-hours construction complaints.
