Full Breakdown

WAMC Section 7.23 bars any noise that unreasonably disturbs the peace and quiet of nearby persons, then lists safe harbors. Construction work performed at construction sites is presumed reasonable only between 7:00 a.m. and 10:00 p.m.; run equipment outside that window and the presumption of reasonableness disappears, exposing the contractor to enforcement by the health officer or police. A contractor needing earlier or later hours can apply to the city clerk for a variance, which goes to a Public Safety Committee recommendation and a Common Council public hearing with 10 days' notice to neighbors within 200 feet. Violations carry a forfeiture of $100 to $500 per offense, with each day a separate offense.

Violations & Fines

Construction noise outside the 7 a.m.-10 p.m. safe-harbor window can be cited as an unreasonable disturbance, carrying a forfeiture of $100 to $500 per offense, with each day of violation counted separately.
