Section 8.16.610 reduces the Table I limits by ten dBA for any source emitting a pure tone or impulsive sound. Chapter 8.16 defines a pure tone as a sound distinctly heard as a single pitch, and it exists when a one-third octave band exceeds the average of its two neighboring bands by five dB for center frequencies of 500 Hz and above, by eight dB between 160 and 400 Hz, and by fifteen dB at or below 125 Hz. Impulsive sound is short, usually under one second, with an abrupt onset, such as explosions, drop forge impacts and firearm discharge.
Section 8.16.620 exempts construction, explosives and firearms, stationary nonemergency signaling devices, emergency signaling devices, domestic power tools and recreational motorized vehicles operating off public rights of way, which have their own sections. It also exempts the unamplified human voice, interstate railway locomotives and cars, and nonstationary farming equipment.
Violations & Fines
A violation of § 8.16.600 is an infraction under § 8.16.800, with a fine of not more than $100 for each offense. A willful or knowing violation carries a fine of not less than $50 and not more than $250 for each offense. Each day of violation is a separate offense, and a court of competent jurisdiction can order abatement of the source of sound within a reasonable time under § 8.16.810.
