The interior table in subsection (c) limits residential interior noise to 35 dBA from 10:00 p.m.-7:00 a.m. and 45 dBA from 7:00 a.m.-10:00 p.m. TMC 5-28-109 applies the standards on a sliding duration scale: the base limit applies for a cumulative period over 30 minutes in an hour, then the standard plus 5 dB for over 15 minutes, plus 10 dB for over 5 minutes, plus 15 dB for over 1 minute, and plus 20 dB (or the maximum ambient) for any period. On a boundary between two zones, the lower zone's limit plus 5 dB applies. These are the City's own standards under its Municipal Code, controlling within incorporated Turlock; Stanislaus County's standards apply only to unincorporated land.
Noise measured at the receiving property above the TMC 5-28-108 exterior limit (or 5-28-108(c) interior limit) for the applicable zone, time, and cumulative duration in TMC 5-28-109, is a violation enforced by the Noise Control Officer. Under TMC 5-28-105 a warning is issued first; persistent or recurring violations are infractions.
