If existing ambient levels are higher, amplified sound may not exceed ambient by more than 3 dBA (A-weighted) or 5 dBC (C-weighted), and a 10 dB increase in any one-third octave band from amplified sound is a violation. For measuring amplified sound, TMC 5-28-107 directs the officer to use the 'fast' meter response. The code also notes (TMC 5-28-104) that noncommercial public speaking and public assembly on public space or right-of-way are exempt. These are the City's own standards under its Municipal Code and apply within incorporated Turlock, not the Stanislaus County code.
Amplified music or a radio/instrument that creates a noise disturbance (TMC 5-28-110(a)), or that exceeds the TMC 5-28-108(d) sensitive-receptor limits (60 dBA day / 45 dBA night A-weighted; 75/70 dBC), can be cited by the Noise Control Officer.
