Outdoor generators and power equipment fall under section 98.02(E) hour limits (7:00 a.m.-10:00 p.m. in summer, 7:00 a.m.-9:00 p.m. in winter), while section 98.03(H) provides that sounds emitted by emergency generators during a power failure, plus periodic testing and maintenance, must adhere to the device limits in section 98.02(B). Section 98.03(I) exempts city-approved construction or road work, and section 98.03(D) exempts emergency construction, repair, or other work. There is also a narrow exemption in section 98.03(E) for sounds associated with the normal operation of the named Gun Club (14926 East 113th Street, Fortville). Because Fishers does not run a separate industrial noise code, commercial and light-industrial operators are bound by the same 115-decibel and device limits as everyone else, enforced as Class C infractions under section 98.99.
Industrial or commercial noise exceeding the section 98.02 limits is a Class 'C' infraction under section 98.99. Fines through the Ordinance Violation Bureau escalate from up to $250 to $500, $1,000, and $2,500 for repeat offenses. Each violation is separate and distinct; Fishers Police issue citations.
