At all other days and times the 90-decibel cap applies, and separately, any device sound audible at least 40 feet from the property line is prohibited. City-, county-, or other government-sanctioned parades, festivals, concert performances, and rehearsals are exempt under section 98.03(C). Following complaints about live music near homes, the Fishers City Council introduced an amendment in December 2024 to reduce the 90-decibel figure to 80 (an earlier draft proposed 70 but was withdrawn after business pushback); readers should confirm the current adopted figure in the live code before relying on 90 vs. 80.
Exceeding the device limits in section 98.02(B) is a Class 'C' infraction under section 98.99, with fines escalating from up to $250 (first) to $500, $1,000, and up to $2,500 (fourth and later) through the Ordinance Violation Bureau.
