Subsection (C) addresses Geist Reservoir specifically: a device played from a watercraft or boat (as defined by Indiana Code 6-6-11-1) may not exceed 80 decibels at the shoreline or water's edge. All measurements use the property line or shoreline as the reference point rather than a fixed distance from the source. A 2024-2025 council amendment was introduced to lower the 90-decibel device figure to 80; readers should verify the currently adopted number in the live code. Violations across all subsections are Class C infractions under section 98.99.
Exceeding any decibel limit in section 98.02 is a Class 'C' infraction. Section 98.99 sets fines payable through the Ordinance Violation Bureau of up to $250 (first), $500 (second), $1,000 (third), and $2,500 (fourth and subsequent). Citations are issued by sworn Fishers Police officers.
