City-approved construction or road work is exempt.
Section 98.02(E) of the Fishers Code governs the hours during which loud equipment may operate. From May 15 through September 15, lawn mowers, weed blowers, garden tractors, construction and repair equipment, go-carts, generators, power tools, and similar machinery may be used only between 7:00 a.m. and 10:00 p.m. From September 16 through May 14, the permitted window narrows to 7:00 a.m. to 9:00 p.m. These hour limits are the practical 'construction curfew' in Fishers. General noise from any source over 115 decibels for more than two minutes per hour remains prohibited under section 98.02(A). Violations are Class C infractions under section 98.99.
Operating regulated equipment outside the permitted hours is a Class 'C' infraction under section 98.99. Fines escalate: up to $250 (first), $500 (second), $1,000 (third), and $2,500 (fourth and later). Any sworn Fishers Police officer may issue a citation; cases are heard in the Hamilton County or Fishers court.
