Outdoor concerts, parades, fireworks displays and other special events are exempt from Clayton County's noise ordinance only when a county permit is obtained, and only within the hours and sound levels set as permit conditions. The county may cap loudness and duration.
Clayton County allows amplified outdoor events but keeps control of loudness and timing. Under § 62-3.4(3), parades, fireworks displays, concerts and other special events are exempt from noise enforcement only when a permit has been obtained from the county, and only within the hours and sound-level limits imposed as a permit condition. The ordinance expressly states the county "reserves the right to set limits on sound levels as well as the duration of sounds emanating from these activities." Temporary events that cannot comply may instead seek a special noise permit under § 62-3.5 (apply 21 days ahead). Without a permit, outdoor music is judged by the general 50-foot reasonable-person standard.
Exceeding permit conditions or holding an unpermitted amplified event is a misdemeanor under Code § 1-12: fine up to $1,000.00 or six months, or both.
