Clayton County, a densely developed metro county with significant industrial areas near Hartsfield-Jackson, exempts routine industrial operations from its noise ordinance. Section 62-3.4(12) provides that noise "created in the ordinary course of existing lawfully permitted businesses in industrial zone classifications" is not a loud, disturbing or unnecessary noise under the code. The exemption is tied to zoning and lawful permitting: an operation must be a permitted use in an industrial classification and the noise must arise in the ordinary course of business. Noise from a business operating outside its zoning, or activity beyond normal operations, is not exempt and is measured against the general § 62-3.2 standard. Nearby residents can still raise nuisance concerns through zoning enforcement.
Non-exempt industrial noise is a misdemeanor under Code § 1-12: a fine not exceeding $1,000.00 or six months imprisonment, or both, plus possible zoning enforcement.
