Clayton County, GA Noise Ordinances: Aircraft Noise (2026)

Clayton County sits directly under the flight paths of Hartsfield-Jackson Atlanta International Airport, but aircraft noise is federally preempted and outside the county's authority. Section 62-3.4(8) of the noise ordinance exempts "aircraft-related noises associated with aircraft while in flight and while under the jurisdiction of the Federal Aviation Administration or the Department of Defense," plus noise from takeoffs and landings of aircraft in distress or under emergency air-traffic-control orders. Aircraft operations, flight paths and noise abatement are set by the FAA and the airport authority, not the county. Residents affected by overflight noise pursue federal noise-abatement programs and airport sound-insulation initiatives rather than a county citation.
