Upper Darby, PA Noise Ordinances: Quiet Hours (2026)

Township Code § 373-6B splits device noise into two prohibitions. the following day, it is unlawful to operate such a device so that it is "plainly audible across real property boundaries or through partitions common to two parties within a building," or plainly audible at 50 feet from a device operating inside a vehicle parked on a public right-of-way or public space. Unlike the general prohibition, the nighttime rule does not require proving a subjective "disturbance," only that the sound is plainly audible at the stated distance or across the boundary, making it easier for enforcement to cite.

Section 373-2 assigns enforcement jointly to the Upper Darby Police Department, the Township Health Officer, and the Department of Licenses and Inspections. Section 373-3 lets enforcement personnel choose between an immediate summons and complaint or a written correction notice giving the violator a specific abatement period before a citation issues; ignoring that notice is itself a separate violation. The chapter's general prohibition in § 373-5 also independently forbids any "excessive or unusually loud noise which creates a noise disturbance" at any hour, which can be charged alongside the nighttime device rule.
