Vehicle sound is regulated as any other sound source under Table 1 (66 dBA day / 55 dBA night residential) and under the Sec. Six(B) noise-disturbance test. Section Seven(F) exempts 'noise resulting from safety features required by law... including, but not limited to, backup alarms or vehicle motion alarms,' and Sec. Seven(C) exempts railways and shipping lanes. Statewide, Florida law (FS 316.293/316.272) also requires working mufflers and limits excessive vehicle noise on public roads, enforced by law enforcement. The county rule applies in unincorporated Lee County.
County noise violation: second-degree misdemeanor, up to $500 or 60 days jail. Statewide muffler/exhaust violations are noncriminal traffic infractions under Florida Statutes.
