Odessa, TX Noise Ordinances: Vehicle Noise (2026)

Sec. 8-2-2(1) of Odessa's noise article sets a bright-line distance test: sound from a radio, tape player, or other electronic or mechanical soundmaking device inside a motor vehicle on a street or highway must not be plainly audible at 100 feet or more from the vehicle. The driver is presumed to be the operator, so no separate proof of who pressed play is needed. Three exceptions apply: law-enforcement and emergency vehicles using required communication gear, vehicles used for business or political purposes that normally use soundmaking devices, and horns or warning devices permitted by state law. Odessa Police enforce it as a Class C misdemeanor nuisance offense.
