Sec. 23-38 sits in the noise article rather than the traffic code, so a citation runs through the county's noise enforcement rather than a Chapter 53 traffic stop, though Chapter 53 is cross-referenced for related vehicle rules. The prohibition reaches three situations: removing muffler-exhaust equipment outright, altering it, for example swapping in a straight pipe or resonator delete, and simply allowing factory equipment to fall into disrepair so severe that it creates loud and disturbing noise. It applies both to the person operating the vehicle and to anyone who allows its operation, which reaches an owner who lets someone else drive a vehicle with a defective exhaust.

Because Sec. 23-38 is not part of the decibel-metered Sec. 23-33 standard or the no-reading-required list in Sec. 23-34, enforcement turns on whether the exhaust noise is objectively loud and disturbing, a judgment call for the citing officer rather than a fixed decibel threshold. The section applies only to vehicles operated within unincorporated New Hanover County; Wilmington, Carolina Beach, Kure Beach and Wrightsville Beach enforce their own municipal exhaust-noise rules. Sec. 23-39's owner-responsibility rule for repeat tenant violations applies to this section as well, once written notice of a prior citation has been given to the property owner.
