Wilmington, NC Noise Ordinances: Vehicle Noise (2026)

Sec. 6-30 lists three vehicle-specific acts among the sounds it specifically declares to be unreasonably loud or disturbing. Subsection (a) bars sounding any horn or signal device on any automobile, motorcycle, bus or other vehicle for an unnecessary or unreasonable period of time, or for the purpose of harassing another person. Subsection (b) bars the use of any siren upon any vehicle other than police, fire, ambulance, or other emergency vehicles, closing off aftermarket sirens on private cars. § 20-128(a), pulling in the state's own equipment standard rather than setting a separate city definition.

All three fall under the article's general misdemeanor classification in subsection (i). Enforcement runs through the Wilmington Police Department, which under Sec. 6-27 has primary responsibility for noise and sound level control citywide, and under Sec. 6-35 an officer can cite any of these without using a sound level meter, relying instead on direct observation or a reliable complaint. § 20-128(a), a driver can face both a city noise citation and a separate state motor vehicle charge for the same defect. The responsible person for a vehicle-based citation is whoever is operating or in control of the vehicle at the time of the violation, per the general liability framework in Sec. 6-36.
