Whitfield County, GA Noise Ordinances: Vehicle Noise (2026)

Sec. 5-41(b)(6) makes it unlawful to discharge the exhaust of any stationary internal combustion engine, motorcycle or motor vehicle except through a muffler or other device that will effectively prevent loud or explosive noises. The same paragraph separately bans the use of special or modified standard equipment exhaust devices on motorcycles or motor vehicles to increase or modify the sound emitted by the exhaust, so aftermarket loud exhaust kits are prohibited outright, not just when audible at a set distance. Paragraph (b)(11) goes further for heavy trucks: it bans the use of an engine braking system, commonly called a jake brake, by any diesel tractor trailer or similar vehicle within unincorporated Whitfield County at any time, and requires that any vehicle equipped with such a system disable it while in the unincorporated county.

That is a blanket, 24-hour ban with no distance or annoyance threshold to prove, unlike most of the rest of Sec. 5-41. Horn and signaling-device misuse is separately addressed in (b)(1), and in-vehicle stereo volume that disturbs others falls under (b)(2)'s radio-in-a-motor-vehicle language. All of these sit inside the same Sec. 5-41 that carries the county's general audibility standard and penalty clause, and none apply inside Dalton, Varnell, Tunnel Hill or Cohutta, which enforce their own city noise codes.
