Des Moines Fire Code under Chapter 26, Article XII adopts the International Fire Code (IFC). IFC 308.1.4 prohibits open-flame cooking devices and LP-gas tanks over 1 pound on combustible balconies of multi-family buildings of three or more units, and within 10 feet of combustible construction. Charcoal grills follow the same clearance. Sprinklered buildings (NFPA 13 or 13R) may qualify for exceptions. Iowa has no statewide preemption of local fire rules.
Des Moines Municipal Code Chapter 26, Article XII adopts the International Fire Code (IFC) as the local fire code, currently the 2018 edition with Des Moines Fire Department amendments. IFC Section 308.1.4 (Open-Flame Cooking Devices) prohibits charcoal burners, other open-flame cooking devices, and LP-gas containers larger than 1 pound on combustible balconies and within 10 feet of combustible construction in buildings with three or more dwelling units. Exceptions apply where buildings are fully protected by automatic sprinklers per NFPA 13 or 13R, or where balconies and decks are of non-combustible construction. Single-family detached homes in Beaverdale, Waveland Park, Highland Park, and East Village face no equivalent prohibition for backyard use, but reasonable clearance from siding and overhangs is required. Iowa Administrative Code 661 (State Fire Marshal) sets statewide minimums; locals may adopt stricter rules. Des Moines Fire Department (DMFD) enforces in coordination with Neighborhood Services Housing Inspection. Iowa Code 364.3 grants cities home-rule fire authority. Property managers for downtown apartments (Court Avenue District, East Village high-rises) and condos at Plaza Condominiums commonly issue stricter no-grill rules.
Chapter 26 fire code violations carry municipal infraction penalties up to $750 per day under Chapter 60 and possible misdemeanor charges in egregious cases. The Fire Marshal may issue immediate stop-use and abatement orders. Insurance loss following grill-caused fires creates separate civil liability. Lease violations supporting eviction proceed through Iowa Code Chapter 562A.
