Charcoal and gas grills may not be used on combustible balconies or within 10 feet of combustible construction, except at one- and two-family homes or where decks are sprinklered. Single-family backyards may grill closer, per the state fire code.
Henrico enforces the Statewide Fire Prevention Code rule that charcoal burners and other open-flame cooking devices, including gas and propane grills, must not be operated on combustible balconies or within 10 feet (3048 mm) of combustible construction. Two exceptions apply: (1) one- and two-family dwellings, and (2) buildings, balconies, and decks protected by an automatic sprinkler system. So single-family homeowners are exempt from the 10-foot rule, while apartment and condo residents generally cannot grill on wood balconies. The Fire Marshal recommends following manufacturer guidance.
Operating a grill on a combustible apartment balcony violates the Statewide Fire Prevention Code; enforced by the fire chief with correction orders and misdemeanor penalties.
