Single-family detached homes in Fairfield may use propane and charcoal grills with normal common-sense clearances. The California Fire Code Β§308.1.4 prohibits open-flame cooking on combustible balconies and within 10 feet of combustible construction at multi-family buildings, with exceptions for sprinklered buildings and small (1 lb) propane containers.
Fairfield adopts the California Fire Code (CFC) through FMC Chapter 5. CFC Β§308.1.4 prohibits charcoal burners and other open-flame cooking devices on combustible balconies or within 10 feet of combustible construction at multi-family residential occupancies (R-2 buildings: apartments, condos, townhouses sharing walls). Exceptions apply where (1) the building, balcony, or deck is protected by an automatic sprinkler system, (2) the open-flame device uses LP-gas containers with a water capacity not greater than 2.5 pounds (about 1 pound of propane), or (3) the balcony is constructed entirely of non-combustible materials such as concrete, steel, or masonry. Propane tanks larger than the 1-lb cylinder may not be stored inside any apartment unit or on a combustible balcony. Single-family detached homes (Group R-3) are not subject to the Β§308.1.4 ban and may use full-size propane grills with normal clearances from siding and overhangs (manufacturer instructions typically require 3 feet). During Red Flag fire weather declared by the National Weather Service for Solano County, the Fairfield Fire Department may issue temporary burn or open-flame restrictions.
Fire Marshal can order immediate removal of non-compliant grills from balconies, issue administrative citations starting at $250, and assess re-inspection fees. Building landlords can be cited for failing to enforce CFC Β§308.1.4 in common areas. Causing a fire creates civil and potentially criminal liability.
