Fresno enforces the California Fire Code (CFC) as adopted in FMC Chapter 10, Article 5 (Fire Prevention). Under CFC Β§308.1.4 (the California amended version of IFC Β§308.1.4), charcoal grills and open-flame cooking devices may not be operated on combustible balconies or within 10 feet of combustible construction at multi-family buildings. Single- and two-family dwellings, sprinklered buildings, and LPG cylinders of 2.5 pounds water capacity or less (nominal 1-lb propane) are exempted.
The Fresno City Fire Department enforces the California Fire Code through FMC Chapter 10, Article 5. CFC Β§308.1.4 prohibits charcoal, wood, and other open-flame cooking devices on combustible balconies or within 10 feet of combustible construction in apartment buildings, condominiums, and other Group R-2 occupancies β meaning most multi-family properties in Fresno. Liquefied petroleum gas (propane) cylinders larger than 1-lb capacity (2.5 lb water capacity) are similarly restricted; only the small disposable 1-lb cylinders used with portable grills are permitted on balconies in multi-family buildings. Exceptions apply when (1) the building or balcony is protected by an automatic sprinkler system, or (2) the building is a one- or two-family detached dwelling. Single-family homes in Fresno may use standard 20-lb propane tanks for backyard BBQs. Open burning for cooking is permitted under the Fire Department's SOP if combustibles are clean dry wood or charcoal, but burning trash, leaves, or yard waste is prohibited under San Joaquin Valley Air Pollution Control District (SJVAPCD) Rule 4103 and FMC. SJVAPCD declares 'No Burn' days during fall and winter that affect even residential wood-fired appliances.
Violations of FMC Chapter 10 fire prevention provisions are infractions subject to citation by Fresno Fire Marshal inspectors. Fines under FMC Section 1-308 reach $100 for a first offense, $200 for a second within one year, and $500 for additional offenses. Causing a fire through prohibited grill use may also trigger civil cost-recovery for suppression expenses.
