Summary

Jefferson Parish caps electronic variable message billboards and other EVM signs at 323 candelas per square meter between sunset and sunrise, or 0.3 foot-candle above ambient light, whichever governs. Every EVM sign, on-premises or off-premises, needs factory-installed ambient light sensors and a manufacturer certification filed with the sign permit confirming the preset intensity can't be tampered with by the operator.

These county ordinances apply to unincorporated areas of Jefferson Parish. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

e. Lighting. The sign shall be equipped with light sensors in accordance with the following: 1. Controls. Ambient light sensors shall be installed prior to the sign's erection on a site and shall automatically adjust the light intensity of the sign based on ambient light conditions. 2. Certification. At the time of application for a sign permit, written certification from the sign manufacturer shall be provided certifying that: i. Ambient light sensors are installed; ii. The light intensity of the sign has been preset to not exceed the levels established by this section; and iii. The preset intensity is protected from end user manipulation by password protected software or other approved method. 3. Nighttime lighting. Between sunset and sunrise, as determined by the National Oceanic and Atmospheric Administration, the maximum light intensity shall not exceed three hundred twenty-three (323) candelas per square meter, or three-tenths (0.3) of a foot-candle above ambient light levels.

Full Breakdown

Section 40-682(3) of the parish zoning code treats every electronic variable message (EVM) sign, on-premises or off-premises, as a lighting fixture as well as a sign. Before an EVM sign goes up, its ambient light sensors must already be installed, and they have to auto-adjust brightness to the surrounding light instead of running at a fixed level. At permit application, the sign manufacturer must certify in writing that the sensors are installed, that intensity is preset within the code's limits, and that the setting is locked behind password-protected software so the end user can't override it.

3 foot-candle above ambient light. If the sign malfunctions, it must freeze on a preset static message and either drop to that 323-candela ceiling or go dark entirely; it can't fail bright. EVM signs may not emit audible sound, and the technology is barred outright on temporary signs, portable signs, animated signs and vehicle-mounted signs used to dodge the rest of the sign code. m. Off-premises EVM billboards carry an additional layer of spacing and residential-setback rules under section 40-684(h)(2), covered separately on this site's digital-billboard page; this page covers only the brightness and glare standard that applies to every EVM sign parish-wide.

Violations & Fines

The department of code compliance and enforcement investigates lighting complaints using a light meter or a nit gun, taking three readings and averaging them, after mailing the owner an inspection-date letter and requiring a prepared solid white test image. Violating any Chapter 40 sign standard, including the lighting rule, is a misdemeanor under section 40-863: a fine of $10 to $100, up to 30 days in jail, or both, with each day of noncompliance a separate offense; the parish can also seek an injunction under section 40-864.

Frequently Asked Questions

What is Jefferson Parish's nighttime brightness limit for billboard lighting?
Between sunset and sunrise, calculated using National Oceanic and Atmospheric Administration data, an electronic variable message sign can't exceed 323 candelas per square meter or 0.3 foot-candle above the ambient light level, whichever the parish measures against. Section 40-682(3)(e)(3) applies the limit to every EVM sign, on-premises or off-premises, parish-wide.
How does the parish test whether a digital sign is too bright at night?
The department of code compliance and enforcement uses either a light meter or a nit gun, taking three separate measurements and averaging the results, per section 40-682(3)(n). Before testing, it mails the owner a letter naming the inspection date and requires a prepared solid white test message be ready and the operator present.
What has to happen if an EVM billboard malfunctions?
Section 40-682(3)(d) requires the sign to freeze on a static default message or image and automatically cap its output at 323 candelas per square meter, or shut its illumination off entirely. A malfunctioning sign is never allowed to fail in a brighter or unregulated state.
Do all digital signs need light sensors?
Yes. Section 40-682(3)(e) requires ambient light sensors to be installed before an EVM sign is erected, and the manufacturer must certify at permit application that the sensors work, the preset intensity meets the code, and the setting is locked behind password-protected software.
