Summary

Victorville's general sign-illumination rules, including a 15-watt bulb cap and a ban on flashing displays, do not apply to digital display billboards. Sec. 16-3.22.070(k) exempts digital billboards erected under a Billboard Relocation Agreement or under Sec. 16-3.22.190's reduction-only conversion path, so those signs follow a separate approval standard instead of the citywide sign-lighting caps.

(k)The following provision governs illumination of signs, excepting digital display billboards erected pursuant to a Billboard Relocation Agreement as provided for in Section 16-3.22.180 or digital display billboards erected pursuant to Section 16-3.22.190:(1)Exposed fluorescent tubes or incandescent bulbs exceeding 15 watts are not permitted, unless such signs are approved as part of a Master Sign Plan or are theater or cinema marquees;... (3)Animated signs that flash or blink are prohibited unless approved by the Zoning Administrator... When no relocation of a billboard is being considered, and when the applicant desires to modify or replace an existing billboard with a Digital Display, the applicant shall remove three (3) existing legal nonconforming billboards within the City and erect one (1) digital display in the same location as one of the billboards being removed. A Site Plan application shall be reviewed administratively and determined by the City's Zoning Administrator.

Full Breakdown

Sec. 070(k) is the City's general illumination provision for signs. It bars exposed fluorescent tubes or incandescent bulbs over fifteen watts unless part of an approved Master Sign Plan or a theater or cinema marquee, requires commercial and industrial signs within 200 feet of a residential district to be sited and built to minimize visibility from that district, prohibits flashing or blinking animated signs absent Zoning Administrator approval, requires cabinet signs to have opaque backgrounds so only the lettering and logo are lit, and bars internally illuminated awnings.

The opening clause of subsection (k) carves digital display billboards entirely out of that list, so long as the billboard was erected under a Billboard Relocation Agreement under Sec. 180 or under the reduction-only conversion path in Sec. 190. Sec. 190 lets an owner convert an existing billboard to a digital display without relocating it, provided the applicant removes three existing legal nonconforming billboards elsewhere in the City and erects one digital display in the same location as one of the billboards being removed; the City's Zoning Administrator reviews that swap administratively through a Site Plan application rather than through the standard sign-permit illumination checklist.

Violations & Fines

A digital display billboard erected without going through the Sec. 16-3.22.180 relocation agreement or the Sec. 16-3.22.190 three-for-one reduction path does not qualify for the lighting exemption in Sec. 16-3.22.070(k), and would instead be measured against the general 15-watt and no-flashing sign standards, which a digital display would fail.

Frequently Asked Questions

Do Victorville's sign-lighting limits apply to digital billboards?
Not to qualifying ones. Sec. 16-3.22.070(k) exempts a digital display billboard from the City's general illumination rules, including the 15-watt bulb cap and the animated/flashing sign ban, as long as the billboard was erected under a Billboard Relocation Agreement or under the reduction-only conversion process in Sec. 16-3.22.190.
How does a billboard owner convert an existing sign to digital in Victorville?
Under Sec. 16-3.22.190, an owner who is not relocating a billboard can convert it to a digital display by removing three existing legal nonconforming billboards elsewhere in the City and erecting one digital display in the same location as one of the removed signs, reviewed administratively by the Zoning Administrator through a Site Plan application.
Are there illumination limits on ordinary commercial signs near homes?
Yes. Sec. 16-3.22.070(k)(2) requires any commercial or industrial sign within 200 feet of a residential district to be situated and constructed to minimize visibility from that district, on top of the citywide 15-watt bulb limit and the ban on flashing animated signs without Zoning Administrator approval.
