A motor vehicle left unattended on public property in violation of law for more than 48 hours, or on private property without the owner's consent for more than 48 hours, is legally abandoned and can be tagged and towed. Abandoning a vehicle carries up to a $500 civil penalty.
Henrico County Code Chapter 22, Article VII covers abandoned motor vehicles. Under Section 22-252, an abandoned motor vehicle is one weighing at least 75 pounds that is left unattended on public property in violation of a state law or local ordinance for more than 48 hours, has remained more than 48 hours on private property without the owner's consent, or is left unattended on the shoulder of a primary highway. Section 22-253 makes it unlawful to cause a vehicle to become abandoned and creates a rebuttable presumption that the registered owner is responsible. The county's Tag and Tow program stickers the vehicle and removes it if it is not claimed. Section 22-254 lets the chief of police take abandoned vehicles
Anyone convicted of abandoning a motor vehicle is subject to a civil penalty of no more than $500.00 under Section 22-253, plus towing and storage charges.
