Apex does not impose a citywide weight or length cap on commercial vehicles in residential neighborhoods, but every commercial vehicle on the public street is subject to Chapter 20 of the Apex Code of Ordinances and NCGS 20-162, which prohibits parking in front of a private driveway, within 15 feet of a fire hydrant or fire station entrance, and within 25 feet from the intersection of curb lines. UDO Section 8.3.4 (Setbacks) restricts off-street parking or storage of vehicles, travel trailers, or motor homes within any front or street side setback area except in the driveway access portion. Storage of mobile homes is not permitted. The Apex Traffic Engineering Manager coordinates with Police, Fire, and Public Works to designate posted no-parking and time-limited zones by ordinance.
Apex regulates commercial-vehicle parking through three layered authorities. First, on the public street, Chapter 20 of the Town of Apex Code of Ordinances (Traffic) controls parking citywide, with Article VIII (Parking) establishing the framework for posted no-parking and time-limited zones. The Traffic Engineering Manager (Sajid Hassan, PE, sajid.hassan@apexnc.org, 919-372-7360) 'coordinates with other departments including Police, Fire, and Public Works to recommend appropriate traffic control measures, where parking may or may not be appropriate and how to properly designate parking restrictions.' Every commercial vehicle is bound by NCGS 20-162(a): 'No person shall park a vehicle or permit it to stand, whether attended or unattended, upon a highway in front of a private driveway or within 15 feet in either direction of a fire hydrant or the entrance to a fire station, nor within 25 feet from the intersection of curb lines or if none, then within 15 feet of the intersection of property lines at an intersection of highways.' Second, on private residential lots, UDO Section 8.3.4 (Location - Setbacks) restricts off-street parking and storage: 'Off-street parking or storage of vehicles, travel trailers, or motor homes shall not be permitted within any front or street side setback area, provided that off-street parking may be permitted within that portion of any setback used for driveway access to required off-street parking areas. Storage of mobile homes is not permitted.' Third, on the abandoned-vehicle side, Chapter 20, Article III (Abandoned, Junked and Disabled Vehicles) applies to commercial vehicles that meet the criteria for an abandoned, junked, health/safety hazard, or aesthetic nuisance vehicle. The Apex Police Department uses Form F1313 - Abandoned, Junked and Disabled Vehicle Violation Checklist to document the violation, with Form F1313a (Pre-towing Notice and Right to Appeal) and Form F1313b (Post-towing Notice and Right to Hearing) for follow-up. NCGS 160A-303.2(b) limits city authority by requiring that 'Any ordinance adopted pursuant to this section shall include a prohibition against removing or disposing of any motor vehicle that is used on a regular basis for business or personal use.' Apex has no dedicated personnel for parking enforcement; patrol officers handle citations among other duties. Apex's local truck restriction notes 'no through trucks allowed between SR 1011 (Salem Street) and SR 1308 (Apex Peakway)' on certain routes.
Parking a commercial vehicle in violation of NCGS 20-162 distance restrictions (in front of a private driveway, within 15 feet of a fire hydrant or fire station entrance, or within 25 feet of a curb-line intersection) is citable on the street under Chapter 20 of the Apex Code of Ordinances. Storing a commercial vehicle, work trailer, or motor home in the required front or street side setback area of a residential lot (other than within the driveway access portion) violates UDO Section 8.3.4. Storage of mobile homes is prohibited outright.
