Tippecanoe County caps how big a truck, semitrailer or bus can be before it is illegal to park on any county highway, street or alley. Under Code § 71.01, trucks over 8 feet wide, 10 feet high or 28 feet long, semitrailers over 36 feet, and buses over 26 feet cannot park outside active loading or unloading.
(2) No person shall park a truck that is wider than 8 feet or higher than 10 feet or longer than 28 feet, which dimensions shall include any load carried thereon on any highway, street or alley, except when loading or unloading as provided by this chapter or other ordinance of the city. (3) No person shall park a semitrailer, either along or coupled to a tractor on any highway, street or alley, that is when alone or coupled to a tractor, wider then 8 feet, higher than 10 feet or longer than 36 feet, which dimensions shall include any load carried thereon, except whey, loading or unloading. Full Breakdown
01(B) sets a family of size and weight caps for on-road parking rather than a district-based ban. No vehicle may park where it leaves less than 10 feet of roadway width for traffic. A truck cannot be parked if it is wider than 8 feet, higher than 10 feet or longer than 28 feet including any load; a semitrailer, alone or coupled to a tractor, is capped at 8 feet wide, 10 feet high and 36 feet long; a bus is capped at 8 feet wide, 10 feet high and 26 feet long.
A separate limit bars parking any vehicle whose gross weight, load included, exceeds 7,000 pounds, and any vehicle wider than 7 feet cannot park on an unimproved road or one with less than 40 feet of paved surface. Vehicles over 7 feet high cannot park within 50 feet of an intersection. All of these caps lift while a vehicle is actively loading or unloading. Division (C) carves out two exceptions: state highways within the county are not covered by divisions (B)(2) through (6), and a mechanically disabled vehicle is excused if the operator sets a lighted flare or electric lantern 100 feet ahead and 100 feet behind it.
The Sheriff also has standing authority to approve non-compliant parking for a specific purpose and limited time. Because these limits attach to the highway, street or alley itself rather than to a residential zoning district, they apply the same way on a rural county road as on a subdivision street.
Violations & Fines
Violating § 71.01's size limits is enforced under the general penalty at § 70.99(A), which routes to § 10.99: a fine of up to $2,500, with each day a truck, semitrailer or bus stays illegally parked counted as a separate offense.
