Tulare County Ordinance Code § 3-03-1015 (Standing or Parking of Commercial Vehicles of 10,000 Pounds or More Prohibited on Certain Highways), as amended by Ord. No. 3561 effective June 20, 2019, makes it unlawful to stop, park, or leave standing any commercial vehicle — as defined by California Vehicle Code § 260 — with a manufacturer's gross vehicle weight rating (GVWR) of 10,000 pounds or more, attended or unattended, on any signed county street or right-of-way. The restriction takes effect once the Board of Supervisors adopts a resolution and the Director of Transportation has posted the appropriate signs. Restrictions may apply by area, duration, or specific hours. Section 3-03-1020 carves out five exceptions: (a) commercial vehicles making pickups or deliveries of goods to a building on a restricted highway in a residential district (per Veh. Code § 515); (b) vehicles delivering materials for a permitted repair, alteration, remodeling, or construction project on the restricted highway; (c) vehicles that must stop to avoid traffic conflicts or in compliance with an officer or traffic control device; (d) utility or public-utility service vehicles working on adjacent utility facilities (warning devices required); and (e) any private, municipal, or public vehicle engaged in work under a County permit or contract (warning devices required).
Violations of § 3-03-1015 are a public offense under § 3-03-1235, prosecuted as a parking violation under California Vehicle Code Divisions 17 (§ 40000.1+) and 18 (§ 42000+). The vehicle is subject to towing under Vehicle Code § 22651 in addition to citation and applicable fines and surcharges.
