Summary

Clayton County bans parking most commercial vehicles, buses, and heavy trailers in residential zoning districts outright: limousines, dump trucks, tow trucks, tractor trailers, and anything over 20 feet long, 7 feet tall, or 7 feet wide. Narrow exceptions cover personal work vehicles, temporary deliveries, and one home-occupation vehicle.

These county ordinances apply to unincorporated areas of Clayton County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)Except as authorized by subsection (b), in all residential zoning districts the parking of the following commercial vehicles is prohibited: limousines, flat bed trucks, dump trucks, tow trucks, transport wreckers, tandem axle trucks, cab-on-chassis trucks, tractor trailers, truck tractors without a trailer, wheeled attachments or trailers, buses, earth-moving machinery, semi-trailers, and any vehicle over 20 feet in length, or seven feet in height, or seven feet in width... (d)With the exception of recreational vehicles and commercial vehicles parked temporarily in conjunction with a service, sale, delivery or pick-up, no vehicle with more than six wheels or two axles or that weighs more than 14,000 pounds or that is over 20 feet in length, or seven feet in height, or seven feet in width shall be parked in a residential zoning district... (g)After giving proper notice of a violation and five business days thereafter to correct the deficiencies, the county shall have the authority to enter the property and bring it into compliance with these regulations by impounding any vehicle found parked on the property in violation of this section.

Full Breakdown

Sec. 62-204(a) names the banned categories specifically: limousines, flat bed trucks, dump trucks, tow trucks, transport wreckers, tandem axle trucks, cab-on-chassis trucks, tractor trailers, truck tractors, buses, earth-moving machinery, semi-trailers, and any vehicle over 20 feet in length, 7 feet in height, or 7 feet in width. A separate size cap in Sec. 62-204(d) bars any vehicle with more than six wheels, two axles, or a weight over 14,000 pounds from a residential district regardless of category, except recreational vehicles and vehicles temporarily parked for delivery or service.

5 tons; and an employer-provided emergency-response vehicle. Commercial or office-institutional districts have their own rules under Sec. 62-204(e): a commercial vehicle may only sit there while actively loading, owned by an on-site business, or in use for on-site operations, and must park in a posted loading zone; sleeping or overnight parking in a loading dock is strictly prohibited, and overnight storage is confined to warehouse, industrial, GB, or LI districts, or a hotel/motel lot for a registered overnight guest (tractor-trailers may only park the cab).

Violations & Fines

A violation is punishable under Sec. 1-12 of the Code against the owner, occupant, or vehicle operator (Sec. 62-204(f)). After notice and five business days to correct the violation, the county can enter the property and bring it into compliance by impounding the offending vehicle (Sec. 62-204(g)). The vehicle's owner must pay towing and storage fees to reclaim it, or it is disposed of under state law. Trucking rental, leasing, or sale facilities operating in GB or LI zones are exempt from the loading-zone restriction under Sec. 62-204(e)(3).

Frequently Asked Questions

Can I park my dump truck at my house in Clayton County?
No. Sec. 62-204(a) specifically bans dump trucks, along with tow trucks, tractor trailers, buses, and any vehicle over 20 feet long, 7 feet tall, or 7 feet wide, from residential zoning districts, with no exception for personal ownership.
Can I keep a work truck at home if I use it for my job?
Yes, if it is limited to 1.5 tons carrying capacity and used exclusively by you as your daily transportation to work, under the exception in Sec. 62-204(b)(1). A second home-occupation vehicle is allowed under the same weight limit if you hold a home occupation business license.
What happens if I leave a banned commercial vehicle parked at home?
After notice and five business days to fix it, the county can enter your property, impound the vehicle, and bill you for towing and storage under Sec. 62-204(g). You must pay those fees to reclaim the vehicle or it is disposed of under state law.
