Full Breakdown
Section 22-15 is a travel restriction, not a parking rule. It controls which streets a commercial vehicle can drive on inside Nicholasville. Parking of two (2)-ton trucks, boats, trailers and campers on city streets is handled separately in § 22-31.
The code defines a commercial vehicle as any motor vehicle used primarily for the transportation of goods, cargo, or passengers for compensation or profit, including trucks, delivery vans, freight carriers, and other vehicles designed for business or commercial use. Residential streets are any street or roadway located within a residential zoning district or primarily consisting of residential dwellings as defined by the city's zoning code. Federal and state roads are the highways officially designated as part of the United States federal or state highway system within the city limits.
Under § 22-15(b)(2), a commercial vehicle can use a residential street only if its destination is on that street or on a street directly accessible only by traveling through the residential area, and only if it enters and exits the residential area by the most direct route, with no unnecessary travel through residential blocks. Section 22-15(b)(3) exempts four groups: emergency vehicles, city maintenance or construction vehicles performing work related to public services, vehicles involved in construction, repair, or delivery services where the work is occurring on a residential street, and utility company vehicles.
Section 22-15(c) requires the City to maintain and make available a list of approved routes, which include federal and state roads and any other routes designated as appropriate for commercial vehicle traffic. Commercial vehicles must follow those routes when traveling through the city, unless accessing a permitted residential area for a specific destination. The section was adopted by Ord. No. 173-2024 on 12-9-24.
Violations & Fines
A first offense draws a fine of $25, a second offense a fine of $50, and any subsequent offense a fine of $100 and/or towing of the commercial vehicle. Repeated violations can also result in suspension of permits for commercial operations within the city. The penalty clause applies to any person or business found in violation, so the operating company is exposed as well as the driver. Section 22-15 names no single enforcing officer.
