Summary

Columbia County requires every off-street parking space, including a driveway or lot serving a permitted use, to be improved with an asphalt or concrete surface under section 90-133(a). The requirement applies whenever a use is established, changed, or a building is erected or expanded, so gravel or dirt parking areas don't satisfy the code in the unincorporated county.

These county ordinances apply to unincorporated areas of Columbia County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)Off-street parking required. At the time of the establishment of or change to a permitted use as set forth in sections 90-50 and 90-97, or erection of any building, or at the time any principal building is enlarged or increased in capacity by adding dwelling units, guest rooms, seats and/or floor area, there shall be provided permanent off-street parking spaces, improved with an asphalt or concrete surface, in accordance with the following:(1)Combination of required parking space. The required parking spaces for any number of separate uses may be combined in one lot, but the required parking spaces assigned to each use may not be assigned to another use...(3)Design of parking lots.b.Each parking space shall not be less than nine feet wide by 18 feet long, except that handicapped spaces shall comply with the requirements of the Federal Americans with Disabilities Act.

Full Breakdown

Section 90-131 opens Article IV's supplemental requirements by declaring they apply in all zoning districts in the unincorporated areas of the county, and section 90-133(a) is the parking rule that follows. Any time a permitted use under sections 90-50 or 90-97 is established or changed, a building is erected, or a principal building's capacity grows by adding dwelling units, guest rooms, seats, or floor area, the property must provide permanent off-street parking spaces improved with an asphalt or concrete surface. Gravel, dirt, grass, or mulch parking areas do not meet this standard.

The section also sets design rules that apply alongside the surface requirement. Parking spaces for separate uses on one lot can be combined, but spaces assigned to one use can't be reassigned to another, except where a church or assembly hall's peak parking demand (nights, Sundays) doesn't overlap an adjacent use's schedule. Required spaces must sit on the same lot or within 300 feet of the use they serve, and none may be reached by crossing an arterial street. Except for one- and two-family residential parcels, lots must be designed so no vehicle backs into a public street to reach it. Every standard space must measure at least nine feet by 18 feet, with handicapped spaces sized to ADA standards, and an off-street parking plan showing the code-required count against the count actually provided must accompany every development application.

Violations & Fines

Failing to pave required parking in asphalt or concrete is a violation of chapter 90 subject to the general penalty in section 1-9: up to $1,000.00 and 60 days in jail under section 90-187, with each day of continued gravel or dirt parking counted as a separate offense. The county attorney or an affected neighboring property owner may also seek an injunction to force compliance or halt use of the property until the surface is corrected.

Frequently Asked Questions

Can I park on a gravel driveway in Columbia County?
Not if the parking area serves a permitted use subject to section 90-133(a): the code requires permanent off-street spaces improved with an asphalt or concrete surface, not gravel or dirt, whenever a use is established, changed, or a building is erected or expanded.
How big does each parking space have to be?
At least nine feet wide by 18 feet long under section 90-133(a)(3), except that handicapped spaces must meet the sizing set by the Americans with Disabilities Act.
Does the paving rule apply to every home in the county?
It applies to off-street parking tied to a permitted use, building erection, or building expansion anywhere in the unincorporated county per sections 90-131 and 90-133(a); the surface standard attaches whenever one of those triggers occurs on the property.
