Fargo Municipal Code § 8-1003(T) adds designated electric vehicle parking stalls to the places where a driver may not stop, stand, or park. The subsection reaches being in the stall and also obstructing it, so a vehicle that blocks a Fargo charging stall without occupying it falls under the same subsection.

The rule attaches to stalls that are designated in a particular way. The designation must be consistent with the manual of uniform traffic control devices authorized under North Dakota Century Code section 39-13-06. The markings must also indicate (1) that use of the reserved space is for charging electric vehicles only, and (2) that unauthorized use of the space is a nonmoving violation for which a fee of fifty dollars must be imposed. A driver pulling up to a designated stall in Fargo is therefore told both the restriction and the fee at the space itself.

The core test is in paragraph (a). An individual may not park or leave standing a vehicle in a stall or space designated for charging a vehicle, unless the individual's vehicle is connected for electric charging purposes. The test is the connection, not the kind of vehicle. A gasoline car in the stall is unauthorized, and so is an electric vehicle that occupies the stall without being plugged in. The wording covers both parking and leaving a vehicle standing, so the rule does not depend on how long the driver plans to stay.

The amount is fixed rather than left to discretion. § 8-1003(T) says a fee of fifty dollars must be imposed, and Fargo's citywide fee schedule at § 1-0305(C)(5) confirms the same $50 figure. The subsection classes unauthorized use as a nonmoving violation, which places it with Fargo's parking violations.
