Full Breakdown
110 sets the design and quantity standards for off-street loading in unincorporated McHenry County. Under subsection A, every required loading space must sit on the same lot as the building it serves, cannot project into a public right-of-way, and cannot be located in a front yard; each space must measure at least twelve feet wide and thirty-five feet long, exclusive of aisles and maneuvering room, with at least fourteen feet of vertical clearance for trucks. Loading surfaces must be paved in a dustless all-weather material such as concrete, asphalt, or brick or stone pavers, and loading drives cannot sit more than six inches below the base flood elevation, tying the standard to the county's Stormwater Management Ordinance.
64-4 sets the required count: a commercial or institutional use needs one loading space for every 10,000 to 100,000 square feet of gross floor area, plus one more for each additional 100,000 square feet, while industrial uses need one space at 5,000 to 10,000 square feet, two spaces from 10,001 to 40,000 square feet, and three spaces from 40,001 to 100,000 square feet. Subsection B caps the total at five loading spaces no matter how large the use is, and in a multi-tenant building, each tenant's square footage is measured separately, so a building where only one tenant exceeds 10,000 square feet needs just one loading space overall.
030(F)(2) requires loading berths in every zoning district to be screened from the street and adjacent properties with a six-foot masonry wall, solid fence, or dense evergreen hedge, unless the Zoning Enforcement Officer determines screening is unnecessary.
Violations & Fines
Failing to provide the loading spaces Table 16.64-4 requires, or building them undersized, unpaved, or in a front yard, is a zoning ordinance violation under Section 16.84.010: a fine of $100 to $500, with each week the deficiency continues counted as a separate offense. The County can also withhold or revoke the occupancy permit for the use until the loading requirement is met.
