Summary

Collier County bans parking of any kind in the public right-of-way unless the county specifically authorizes it first. Section 110-31.A folds that ban into the same right-of-way permit ordinance that governs digging and construction work, so a car left on the shoulder or swale overnight is treated the same as unpermitted excavation.

These county ordinances apply to unincorporated areas of Collier County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

A.It shall be unlawful for any Responsible Party to dig, excavate, obstruct, or place any construction or other material, or perform any other work which disturbs the existing structure and/or compaction of soil in any right-of-way provided for public use in Collier County, including any public right-of-way maintained by Collier County within the boundaries of any municipal corporation, without first obtaining a permit for such work from the County as specified herein or in the Handbook as defined in Section 110-28. In addition, it shall be unlawful for any Responsible Party to park in any right-of-way provided for public use in Collier County, unless otherwise authorized by the County.

Full Breakdown

A, part of the Collier County right-of-way construction ordinance, states that it shall be unlawful for any Responsible Party to park in any right-of-way provided for public use in Collier County, unless otherwise authorized by the County. The ordinance defines right-of-way to include county-maintained rights-of-way even inside the boundaries of a municipality, and defines Responsible Party broadly enough to reach any individual, firm, corporation, association or other entity in control of the vehicle or activity, with fee title owners on the hook if the actual responsible party cannot be identified.

Because the ban carries no time-of-day carve-out, it covers overnight parking exactly the same as daytime parking: a vehicle left on the road shoulder, swale or unopened right-of-way strip after dark is unauthorized unless the County Manager or a designee has granted authorization for that specific use. The same Article II that created the parking ban supplies its enforcement teeth. 00, with each day of continued violation counted as a separate offense, and the responsible party also owes all court costs and expenses of the case. ch. 162, and Section 110-34 makes this article cumulative with, not a substitute for, any other applicable county ordinance.

Violations & Fines

A parked vehicle in the right-of-way without county authorization is a civil violation carrying a fine of up to $1,000.00 under Section 110-36(a), with every additional day counted as a new, separate violation, plus the offender's court costs and case expenses. Collier County can also seek an injunction or damages in circuit court, or pursue the matter through the code enforcement board established under Chapter 162, Florida Statutes, and all of these remedies are cumulative rather than exclusive under Section 110-36(d).

Frequently Asked Questions

Can I park my car on the street shoulder overnight in unincorporated Collier County?
Not without county authorization. Section 110-31.A bans parking in any public right-of-way in Collier County unless the County specifically allows it, and the ban applies at every hour, so an overnight stay on the shoulder or swale is treated the same as a daytime one.
What counts as the "right-of-way" under this rule?
The ordinance reaches every right-of-way provided for public use in Collier County, including county-maintained rights-of-way that sit inside the boundaries of Naples, Marco Island or Everglades City, under the plain wording of Section 110-31.A, so parking there without county sign-off is unlawful no matter which side of a city line the street falls on.
How much is the fine for parking in the Collier County right-of-way?
Section 110-36(a) sets a civil fine of up to $1,000.00 for a violation, and because each day the vehicle stays counts as its own separate violation, the total owed can climb quickly if the vehicle is never moved off the right-of-way.
Can Collier County do more than just fine me for an illegal right-of-way vehicle?
Yes. Section 110-36(b) and (c) let the county seek an injunction or sue for damages in addition to the fine, and pursue the case through the code enforcement board created under Chapter 162, Florida Statutes, since all these remedies are cumulative under the ordinance.
