San Jose follows California's strict recording laws. California Penal Code Β§632 makes it a crime to record confidential communications without the consent of all parties. This applies to phone calls, in-person conversations, and any electronic communications where parties have a reasonable expectation of privacy. The first offense is a misdemeanor or felony (wobbler) with fines up to $2,500 and/or up to one year in jail. Subsequent offenses carry higher penalties. Video recording without audio in public spaces is legal. Recording in public where there is no expectation of privacy (street, park, store) is generally permissible. California Penal Code Β§647(j) prohibits using recording devices for voyeurism. Law enforcement recordings require a warrant or wiretap order under CA Penal Code Β§629.50. Journalists have limited protections under the California Shield Law but still must comply with Β§632 for private conversations.
