The City of Upland regulates garage and yard sales under Section 5.20.070 of the Municipal Code. An application must be made to, and a permit obtained from, the Finance Department to conduct a yard sale. A single address may hold up to three yard sales in a calendar year. Each yard sale may run no more than three consecutive days and may be conducted only between the hours of 8:00 a.m. and 8:00 p.m. Signage is limited to one sign posted on the property where the sale is held, displayed only during the sale; the sign may not exceed two feet by two feet and may not be placed in the public right-of-way. No purchased or consigned merchandise may be offered for sale, which keeps yard sales limited to genuine household goods rather than ongoing retail. These are city requirements; San Bernardino County's rules do not apply within Upland. Residents can apply through the Finance Department / Customer Service Utility Billing. Because Upland requires a permit and caps the number, duration, hours and signage, it is more restrictive than a city with no garage-sale ordinance at all.
Holding a yard sale without a permit, exceeding three sales per year, running more than three consecutive days, operating outside 8 a.m.-8 p.m., oversized or right-of-way signage, or selling purchased/consigned merchandise all violate Section 5.20.070. Enforcement is through Code Enforcement and the Finance Department.
