Fire pit rules in Upland, CA — also called outdoor burning, recreational fire, or open flame ordinances — cover fuel types, clearances, and when burning is allowed.
Upland follows the San Bernardino County Fire Protection District's outdoor fire rules. A permanent fire ring or portable outdoor fireplace fueled only by propane or natural gas needs no permit but must sit at least 15 feet from any structure. Wood- or charcoal-burning recreational fires require a permit and must be at least 25 feet from structures.
Upland does not run its own fire department — the San Bernardino County Fire Protection District (SBCFPD) has been Upland's fire agency since July 22, 2017, and Upland Municipal Code Chapter 8.28 adopts the SBCFPD Fire Code. Under SBCFPD's outdoor fire safety rules, a 'recreational fire' has a fuel area that 'shall not exceed 3' high x 2' wide.' Wood- or charcoal-burning recreational fires require a permit. The exception: 'When confined to a permanent fire ring and it is fueled solely by LPG/Propane or natural gas — no permit required.' Distance rules apply: a recreational fire 'must be a minimum of 25' away from a structure or other combustible materials,' but this 'may be reduced to 15' when confined to a permanent fire ring and fueled solely by LPG/Propane or natural gas.' A portable outdoor fireplace 'shall be no closer than 15' to a structure or combustible materials,' and portable outdoor fireplaces are prohibited on combustible patios or balconies of multi-family dwellings unless sprinklered. Only clean, dry wood or charcoal may be burned; trash may never be burned. All fires must be attended by a responsible adult 18 or older until fully extinguished. Note South Coast AQMD prohibits residential open burning in the San Bernardino Valley, where Upland sits, so a gas-fueled fire ring is the simplest compliant option.
Burning without a required permit, burning prohibited materials (trash), placing a fire pit too close to structures, or leaving a fire unattended violate the SBCFPD Fire Code adopted by Upland (UMC Ch. 8.28). Open residential burning also violates South Coast AQMD rules. Enforcement is by SBCFPD and city code enforcement.
