Upland bans ALL fireworks, including 'safe and sane.' Unlike many California cities that allow State Fire Marshal-approved 'safe and sane' fireworks, the City of Upland prohibits all of them. Upland's own Municipal Code Chapter 8.28 (Fire Prevention and Suppression) defines 'fireworks' by reference to California Health and Safety Code Section 12511 and expressly includes both 'dangerous fireworks' and 'safe and sane fireworks.' The ordinance states it is 'unlawful for any person, business, or entity to possess, use, explode, ignite, discharge, sell, give away, display, display for sale, or improperly store any fireworks within the city.' Fireworks may not be carried or transported outside unless 'safely stored in a locked container rated for containing explosives.' The only exception is a public fireworks display put on by the city or with the city's written permission. Any peace officer, the fire chief, fire marshal, or code enforcement officer may seize and impound illegal fireworks. The city can enforce 'by any means available at law, including, but not limited to, administrative enforcement, administrative fines, criminal prosecution, civil enforcement, restraining orders, or injunctions.' Fire protection in Upland is provided by the San Bernardino County Fire Protection District, which has served as Upland's fire department since 2017. State law (Health and Safety Code Part 2) independently bans 'dangerous fireworks' statewide.
Any violation is 'hereby declared unlawful, a misdemeanor, and a public nuisance punishable per Title 1 of this code' (UMC 8.28.040). The city may pursue administrative fines, criminal prosecution, civil enforcement, or injunctions, and may seize and impound the fireworks. Selling or using state-banned 'dangerous fireworks' also violates California Health & Safety Code Part 2 (12500 et seq.).
