The City of Upland prohibits keeping poultry for any purpose in single-family and multifamily residential zones, along with horses, mules, ponies, goats, sheep, cows, calves, and similar livestock. Backyard chickens and roosters are not allowed in standard residential neighborhoods. Limited agricultural use may be permitted only on lots of at least one acre with a conditional use permit.
Unlike some California cities, Upland does not have a backyard-chicken allowance. Its zoning regulations for the SFR Single-Family Residential zone (Prior code Section 9613.060, Ord. 1835) expressly prohibit the keeping of poultry for any purpose and the keeping of rabbits for the purpose of sale or breeding. The same prohibition applies in the MFR Multifamily Residential zone. These provisions also bar the keeping of horses, colts, mules, ponies, goats, sheep, cows, calves, or animals of general like character in residential zones. Because the rule prohibits poultry 'for any purpose,' both hens and roosters are excluded in typical residential neighborhoods; the often-repeated claim that Upland allows up to five backyard hens is not supported by the city's own code. The zoning code does allow interim agricultural uses such as farms, orchards, field crops, and gardening on plots of not less than one acre in an SFR zone, but only subject to approval of a conditional use permit. Title 6, Chapter 6.04 of the Animal code directs that anyone keeping larger animals also comply with the California Food and Agricultural Code. Residents wanting to keep any fowl or livestock should confirm parcel zoning and CUP requirements with the City of Upland Planning Division.
Keeping chickens, roosters, other poultry, or prohibited livestock in a residential zone is a zoning violation subject to code enforcement; agricultural use without a required conditional use permit is also prohibited.
